Nicollette Sheridan has been denied a retrial. She is an English actress, and she is known for playing Edie Britt on the television series Desperate Housewives, and she has been a wrongful termination case against Desperate Housewives producers for the second time in as many months. It was back in 2010 when she had filed the suit against creator Marc Cherry and producers at Abc and Touchstone, when she was claiming her character in which she played got killed off in 2009 because she was going around saying she got hit on the had by Cherry during a rehearsal in September, 2008.
Her sexual harassment, assault and wrongful termination allegations were reduced to wrongful termination and battery before the trial, while Cherry was dropped as a defendant.The case was ultimately ruled a mistrial in Sheridan’s favour.
An appellate court later determined the trial judge should have issued a different verdict and suggested Sheridan re-file under California’s labour code, which she did – only for her case to be disallowed last November (13) because she had waited too long to take action.
However, in January (14), Los Angeles Superior Court judge Michael Stern gave Sheridan hope by granting a motion for reconsideration, which was then declared invalid by appeal court judges last month (Aug14), amid allegations Stern no longer had the jurisdiction to revive the matter.
The issue returned to court on Tuesday (23Sep14), when Stern officially vacated his order for a new trial.
Sheridan’s lawyers have reportedly indicated that they will continue on fighting the case and are working on an appeal.
